The short version

- Service is provided "as-is". Transcription accuracy depends on audio quality and is not guaranteed.
- Don't use Whispy for illegal stuff. Common-sense list below.
1. Agreement
These Terms ("Terms") are a contract between you and Whispy. By creating an account, installing the desktop app, or paying for a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
If you are using Whispy on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.
2. Your account
- You must be at least 16 years old.
- You must provide an accurate email address and keep it current.
- You are responsible for keeping your password secure and for everything that happens under your account.
- Tell us via the contact page immediately if you suspect unauthorized access.
3. System requirements
Whispy is a desktop application. To run it correctly your system must meet, at minimum:
- macOS 12 (Monterey) or newer, or Windows 10 build 19041+ / Windows 11.
- Approximately 500 MB free disk space for the app and a working folder for recordings (your storage scales with how much you record).
- At least 4 GB RAM, working microphone, and (for video) camera + screen-recording permissions granted to the app.
- A stable internet connection capable of streaming audio (~64 kbps sustained).
- Permission to grant the app access to system audio for capturing the other side of meetings.
- Your own valid API keys for Deepgram (transcription) and Anthropic (AI replies).
Where the app cannot run because your system does not meet these requirements, refunds are not available. The system requirements are listed before purchase; it is your responsibility to confirm compatibility before subscribing. We recommend using the 7-day free trial to verify Whispy works on your specific machine.
4. Subscription, billing and trials
- Pricing (when paid plans open): ₹399 / $5 per month or ₹2,999 / $49 per year. The amount and currency you see at checkout — based on your country — is the authoritative price.
- New accounts receive a 7-day free trial. No credit card required to start. The trial does not auto-convert; you will have to actively subscribe to keep using the app after it ends.
- Billing renews each period until you cancel. Cancellation takes effect at the end of the current paid period — you keep access until then.
- Taxes and applicable GST / VAT are added on top of the listed price where required by law.
- Payment is processed by our payment partner (Razorpay). We do not store full card numbers ourselves.
5. Refunds and non-refundable items
Whispy is a subscription service. The following refund rules apply:
- Cancellations are not pro-rated. If you cancel mid-period you keep access until the end of the period you've already paid for. We do not refund partial months or partial years.
- System-incompatibility is not refundable. If the app does not run because your device does not meet the system requirements in Section 3, that is not grounds for a refund. Use the free trial to confirm compatibility first.
- Third-party costs are not refundable by Whispy. Charges from Anthropic, Deepgram, or any other service you connect via your own API keys are between you and that provider. We have no visibility into or control over those bills and cannot refund them under any circumstances.
- Transcription accuracy is not grounds for refund. Speech recognition is best-effort and depends on audio quality, language, accent, background noise, and the configuration you choose. We do not warrant any particular accuracy level.
- AI suggestions are not advice. Replies generated by Whispy are starting points written by an AI model. You are responsible for what you say in your meetings. Poor or unhelpful suggestions on a specific call are not a refundable defect.
- Recording-consent violations are not refundable. Loss arising from using Whispy without obtaining the consent required by law where you and other parties are located is your responsibility.
- Goodwill exception. Where the app materially fails to deliver a core advertised feature on a system that meets the requirements above, Whispy may, at its sole discretion, issue a fix, a service credit, or a refund. This is not a contractual guarantee — each case is evaluated individually. Reach out at our contact page with the details and we'll respond within 5 business days.
Nothing in this section limits any non-waivable consumer-protection rights granted to you by the law of your country of residence.
6. License grant
Subject to these Terms, Whispy grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Whispy desktop app for your own personal or internal business purposes.
One device at a time. A single Whispy account can be signed in on one active device at a time. To move to a new laptop, sign out on the old one (or revoke it from your dashboard).
7. Bring-your-own API keys
Whispy requires you to provide your own API keys for Deepgram (transcription) and Anthropic (AI replies). The cost of those API calls is billed by those providers to you, not by Whispy. Typical usage runs ~$0.20 per 30-minute call but you are responsible for your own consumption.
Your API keys are encrypted on your device using your operating system's keychain. Whispy never receives or stores your keys on our servers.
8. Acceptable use
You agree NOT to use Whispy to:
- Record people without the consent required by law where you and they are located.
- Capture confidential information in violation of an NDA, employment contract or fiduciary duty you owe.
- Cheat in any examination, certification, licensing test, or interview where the use of AI assistance is expressly prohibited by the test administrator.
- Impersonate another person, including using their likeness or voice without permission.
- Process health, legal, financial or other regulated data without complying with the laws (HIPAA, GDPR, etc.) that apply to you.
- Reverse-engineer, decompile, or attempt to extract source code from the desktop app, except to the extent local law expressly permits.
- Resell, sublicense or white-label Whispy without a separate written agreement.
- Use Whispy to build a competing product or to train another AI model.
- Probe, scan, overload or disrupt the Whispy service or its infrastructure.
We may suspend or terminate accounts that violate this section. Where a violation is unintentional, we'll usually warn you first.
9. Recording consent is your responsibility
Recording laws differ between countries and US states (one-party vs two-party consent). It is your obligation to obtain the consent the law requires from everyone on your call. Whispy is the tool; the policy on each call is yours.
10. Your content
Whispy does not claim ownership over your recordings, transcripts, summaries, prompts or knowledge files. You keep all rights to them. Because they are stored locally on your device, we do not access them and have no license to do so.
11. Our content & trademarks
The Whispy name, logo, website copy, app UI, illustrations and software (excluding open-source components, which are licensed separately) are owned by Whispy. You may reference Whispy in news, reviews and educational content; you may not use the marks to imply a partnership, endorsement, or affiliation that doesn't exist.
12. Third-party services
Whispy integrates with third-party services (Deepgram, Anthropic, Stripe, etc.). Their terms govern your use of those services. We are not responsible for outages, errors or content originating from those providers.
13. Changes to the service
We will add features, improve them, and occasionally retire ones that aren't working. For material changes that reduce functionality we rely on, we'll give at least 30 days notice by email.
14. Termination
You may cancel at any time from your dashboard. We may suspend or terminate your access for a material breach of these Terms, non-payment, or sustained abuse. On termination, your right to use the service ends; your locally-stored files remain on your device.
15. Disclaimers
Whispy is provided "as is" and "as available". AI-generated suggestions are not advice — they are starting points, and you are responsible for what you say in your meetings. Transcription accuracy depends on audio quality, language, accent and background noise; it is not guaranteed.
To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of liability
To the maximum extent permitted by law, Whispy's total liability for any claim arising out of these Terms or your use of the service is limited to the greater of (a) the amount you paid Whispy in the 12 months preceding the claim, or (b) USD 100.
Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
17. Indemnification
You agree to indemnify Whispy against claims arising from (a) your violation of these Terms, (b) your violation of any law (including recording-consent laws), or (c) your use of the service in a way that infringes a third party's rights.
18. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict of laws principles. The courts of Pune, Maharashtra have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence says otherwise.
19. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Whispy.
- Severability. If a clause is unenforceable, the rest still applies.
- No waiver. Not enforcing a right once is not a waiver of it later.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger or acquisition.
